ERC leader Oriol Junqueras has filed a lawsuit against the European Parliament before the General Court of the European Union for having replaced his seat. After Jordi Solé took the Junqueras seat in July, the defense of the ERC leader decided on October 3 to file an appeal against the European chamber before the TGUE for this change.
From ERC they assure that it is a “legally essential” step to fight for his mandate. In fact, Junqueras is pending an appeal in Luxembourg against the refusal of the European Parliament to maintain his mandate as MEP by the decision of the Supreme Court.
ERC points out that Junqueras does not renounce his seat and that they will continue “fighting until it is recognized that fundamental rights have been violated.” From the European Parliament they say that in January they informed Solé that “he was next on the list” but that “at that time he did not take any steps to fill the vacancy”. “Now it has done so,” parliamentary sources said in July. ERC, on the other hand, attributes the decision to the camera.
