The European Court of Human Rights sees “unfounded” the complaints of two residents of Bages

The European Court of Human Rights has dismissed the first two appeals filed against the State for the police charges during the unilateral referendum on October 1 in Catalonia. The European Court based in Strasbourg considers the complaints to be “unfounded” and sees no evidence of violations of fundamental rights.

This is how the court responds to the appeals that in August 2020, after exhausting the internal judicial process, two residents of Bages presented to denounce Spain for violating their right to a fair trial, considering that a “very scarce” investigation of police charges. These citizens also denounced that other fundamental rights had been violated, such as the right to assembly, freedom of expression and the right not to be subjected to inhuman or degrading treatment.

The complainants, J.P.R and S. T. V, were two of the 16 people slightly injured during a charge by the Civil Guard at the Sant Miquel school in Castellgalí, a town of about 2,000 inhabitants near Manresa. Dissatisfied with the filing of the case in Spain, they were the first two citizens to turn to Strasbourg.

No evidence of violation

As the ACN agency has learned, on May 25, the ECHR declared these two appeals inadmissible because the complaints were “unfounded” and did not see signs of violation of fundamental rights.

A chamber made up of a single judge has been the one that has studied the case and has concluded that “in view of the evidence provided, it does not appear that there has been a violation of rights and freedoms” of the European Convention on Human Rights, according to It is stated in the notification of the European court.

The pending cases for the police charges of 1-O

The decision is final and cannot be appealed. However, this does not prevent others affected by the 1-O police charges from also appealing to the European Court of Human Rights in Strasbourg when the corresponding judicial process in Spain is finished.

Dozens of police officers and civil guards remain accused of using excessive force in their charges to prevent the 1-O vote. Their causes are distributed in various courts in Catalonia.
