Receiving the ERC militants who have been pardoned, Aragonès referred to the “roadmap” that he would propose to Pedro Sánchez: “that the report of the Council of Europe be complied with.” He also said that he would demand amnesty to close the judicial investigations and stop the “economic inquisition” of the Court of Accounts. Finally, he said that the referendum would be beneficial for all. Well, the Council of Europe report rejected the amnesty; and it is not far in favor of a referendum. Mixing concepts, Aragonès confuses public opinion. He repeats a dangerous game. Again, the temptation of deception.
The EC report does not endorse either the speech or the strategy of the independentists. True: it is very favorable to them in the judicial aspect. He calls for the correction of the crimes of sedition and rebellion that were used to punish a referendum that, despite being illegal, was decriminalized. He demands the freedom of the condemned and the suspension of the proceedings for residents abroad.
The abuse of a Kafkaesque court must be opposed, but the accounts must be passed
On the other hand, it is contrary to the independence theses when it maintains that the approval of the disconnection laws and the holding of the referendum disobeyed the TC and were unconstitutional. The independentists, the report says, can be “forced to undertake their political objectives without resorting to illegal means.” It says “compel”, not suggest or recommend. It also makes it clear that Spain is a rule of law and that its courts are independent.
The pardons serve to eliminate from the political debate an emotional element that distorted everything. It seems that, through the peculiar Court of Accounts, new elements of punishment are introduced that may continue to artificially distort politics. Ruining the families of the independence charges would be a serious institutional abuse, especially if it is done arbitrarily. But ensuring that public money has not been used for uses not contemplated by law is not, from the outset, any abuse, as long as these uses are reliably demonstrated as the Council of Europe requests, precisely.
One must oppose the abuse. It cannot be accepted that a court, in which a former Aznar minister stands out, who was so gracious in evaluating Ana Botella’s highly debatable urban sales, now acts as implacably, unappealable and inaccessible as the court in Kafka’s trial. Now: passing accounts is essential. Political and economic accounts. Taking for granted that pardons are a minor gift, parading the sanctified martyrs of the independence movement in procession as if they had no responsibility for the events of 2017, distorting the report of the Council of Europe into an absolute endorsement is returning to the cheap game of political deception. The deception, you saw, led us to a dead end. You get out of the labyrinth thanks to criticism, yes, but also to self-criticism. Repeating the play of the lie would be equivalent to leaving the fire to fall into the embers.
